Goebel v. Raeburn, 289 A.D.2d 43, 735 N.Y.S.2d 4 (1st
Dep't 2001). Along with Daniel Kornstein, Ina won a motion
to dismiss the complaint on Statute of Frauds grounds. The
case arose from an alleged agreement for the sale of real
property in Manhattan. Ina also prevailed on plaintiff's appeal
to the First Department.
Host
Marriott Corporation v. Beth Israel North. Along with
Marvin Wexler, Ina prevailed on a motion for summary judgment
dismissing the case against the hospital. Plaintiff sought
indemnification pursuant to a services contract for damages
incurred in connection with a lawsuit by an injured employee.
The hospital successfully argued that plaintiff had waived
indemnification rights for failure to assert dispositive "special
employee defense" in underlying litigation.
Anonymous
v. Anonymous. Ina represented a husband-physician in contentious
divorce/custody dispute. After two trials, she obtained an
equitable distribution award which was favorable to the husband
and a visitation schedule whereby parties' child spends two
weeks of every month with his father.
Finkelstein
v. Wachtel, 2003 WL 1918309 (S.D.N.Y. 2003). After a trial
(hung jury), Ina, along with Daniel Kornstein, prevailed,
on post-trial motions, in dismissing a case against an attorney
for claims of tortious interference with prospective economic
advantage and business defamation.
Troika
v. New Park Entertainment, (American Arbitration Association).
Ina represented a musical production company in a dispute
against a theatrical venue owner/operator arising from amounts
unpaid under several contracts. After a two-day arbitration,
Ina won judgment for 100% of amounts sought.
